Among the limitations placed on the performance of a sound recording was the creation of a statutory license that permits certain subscription\par digital audio Services to publicly perform those sound recordings through digital audio transmission. In order to operate under the license, eligible\par subscription digital audio Services must pay the statutorily required fees and comply with certain other conditions, such as adherence to notice and\par recordkeeping requirements.\fs20\par \cf0\f1\par \cf1\f0\fs18 On May 13, 1996, the Copyright\par Office published a Notice of Proposed\par Rulemaking (NPRM) in the \b\f2 Federal\par Register \b0\f0 requesting comments on the\par requirements by which copyright\par owners should receive reasonable notice\par of the use of their works from\par subscription digital transmission\par Services and how records of such use\par should be kept and made available to\par copyright owners.
