Fondren Library Electronic Reserve Guidelines
The American Library Association published, Model Policy
Concerning College and University Photocopying for Classroom,
Research and Library Reserve Use. In general, the Model Policy
with respect to classroom use suggests that these standard guidelines
be followed:
- The distribution of the same photocopied material does not
occur every quarter without permission.
- Only one copy is distributed for each student.
- The material includes a copyright notice on the first page of
the portion of material photocopied.
- The students are not assessed any fee beyond the actual cost
of the photocopying.
Proposed Guidelines For Fondren Library
- The Electronic Reserve System should be limited to the Rice
University community which is comprised of students, faculty and
staff.
- The following copyright warning should be attached to each
document in the Electronic Reserve System:
WARNING CONCERNING COPYRIGHT RESTRICTIONS
The copyright law of the United States (Title 17, United States
Code) governs the making of photocopies or other reproduction
of copyrighted material.
Under certain conditions specified in the law, libraries and
archives are authorized to furnish a photocopy or other
reproduction. One of these specified conditions is that the
photocopy or reproduction is not to be used for any purpose
other than private study, scholarship, or research. If
electronic transmission of reserve material is used for
purposes in excess of what constitutes "fair use", that user
may be liable for copyright infringement.
- Material in the Electronic Reserve System (exams, lecture
notes, articles, book chapters) should only be accessed by course
name or professor name in the public access database. The title or
author should not be searchable which will help to ensure that the
main users of the material will be students who are enrolled in
the class.
- At the end of each semester, all material in the Electronic
Reserve System will be suppressed from the public access database,
unless it does not fall under copyright restrictions or unless
copyright permission has been requested by reserve staff and
granted by the publisher.
- Fondren Library will pay any reasonable fees charged by the
publisher. While waiting for permission from the publishers,
the Reserve staff will place materials on the Electronic Reserve
System. Materials that have not received necessary permission will
be removed from Electronic Reserves after one semester and may not
be re-submitted for use until evidence of current copyright
permission is furnished to the Reserve Desk staff. All letters
of permission received from publishers and other evidence of
permission granted to faculty members by publishers are kept on
file at the Reserve Desk. Specific publisher requirements are
followed.

Without Obtaining Copyright Permission

- Exams, exam keys, and homework solutions
- Lecture notes
- Student papers
- Government publications
- One article from a journal issue
- One chapter from a book
When To Write For Copyright Permission For Electronic Reserve
(Guidelines for Fondren Library)
- When an article from a journal is needed by a professor for
more than one semeseter.
- When multiple articles from one journal issue are needed for
electronic reserve.
- When one chapter of a book is needed by a professor for more
than one semester.
- When multiple chapters of a book are needed for electronic
reserve.
- When an out of print book is needed for electronic reserve.
We will not place an entire book or journal which is in print,
in the Electronic Reserve System.
